Find our terms and conditions that govern the use of our website, mobile application, and other services provided by Re-nya (collectively, our “Services”) by you (the “User”). Before you use any of our Services, please read the relevant information below for you so that you understand the legal rights and obligations, as well as the conditions, limitations, and exclusions, that apply to you. By using any of our Services (even just browsing through our website), you are agreeing to comply with all of the terms and conditions that apply to you:

1. Subject-matter of the Terms of Use of the Web Site
Re-nya is a private limited company incorporated in the United Kingdom, whose registered address is 889 Harrow Road, Sudbury, Wembley, Middlesex, England, HA0 2RH , registered in London, United Kingdom under number 12085261. It owns all the rights over the http://www.re-nya.com web site (the “Web Site”). These Terms of Use apply to all the Users of the Web Site. They lay down the terms and conditions under which Re-nya enables the Users to access the Web Site and to use its various functionalities. All Users are advised to carefully read all the Terms of Use that are applicable to them before using the Web Site, and to ensure that they understand them, for they set out their rights and obligations.
2. Creating an account
In order to access the functionalities of the Web Site, Users must create an account using their email address and a password. The Users undertake to input accurate and up-to-date information as part of the account opening process. Opening an account is free of charge and there is no obligation to buy or sell anything on the Web Site. Users must be aged over 18 and must have full legal capacity to enter into a sale. Once registered, Users shall be able to access and use their accounts using their email address and the password that they created upon registering on the Web Site. These identifiers, for which the Users shall be responsible at all times, must be keyed in whenever opening a session and the Users must never disclose them to any third party nor let any third party use them. The Users undertake not to create or use any accounts other than the account that they shall have created initially, be it under their own identity or that of a third party. The Users undertake not to choose a username that provides a means of identifying an ecommerce web site other than the Web Site. Should any User fail to comply with this prohibition, Re-nya shall be entitled to close that User’s account immediately. The Users undertake to inform Re-nya via Quick Contact form at the footer of the Web Site about any fraudulent use of their username, their identifier and/or their password by a third party, as soon as they shall become aware of this. The Users undertake to compensate Re-nya should the latter suffer any damage or loss or incur any costs as a result of any other person accessing information in a User’s account on the Web Site, if the User involved authorised this use or was aware of it. Users should note that upon using the Facebook Connect functionality to register on the Web Site, they shall be asked to permit Re-nya to access some information pertaining to their Facebook accounts, including their family name and first name, their Facebook identifier, their email address, their gender, their date of birth, their profile photograph, their list of friends, and all other public information contained in their Facebook account.
3. Role and responsibility of Re-nya as part of the use of the Web Site
It is up to the Users to ensure that all their acts and all the User content that they put online on the Web Site comply with the legislation that is applicable to them. Re-nya hereby disclaims liability for any damage or loss arising from any activity performed by the User on the Web Site, such as, but not limited to, any losses of data, any loss of a sale or purchase opportunity, any loss of earnings, of turnover, of business activity, of opportunities or of clients, any damage to the User’s reputation or interruptions of their activity, and any indirect loss or damage incurred by the User, or any impediment or delay in the performance of its obligations caused by any act or omission on the part of a User (or of any person acting for and on the User’s behalf) or arising from force majeure. Re-nya shall not be liable for any content that is hosted on third party web sites that are accessible from the Web Site; these shall be the responsibility of the third party sites themselves. It is up to the Users who hold intellectual property rights over any content hosted on a third party web site and who did not authorise the use of their content, to contact the administrator of the third party web site involved directly and request that the contentious content be deleted from the web site in question. Re-nya does not provide any warranty against losses or damage that may be caused by the transmission of a computer virus, a worm, a time bomb, a Trojan horse, a cancelbot, malware or any other program designed to damage, destroy or degrade in any other way a functionality of a computer, or to impede the proper operation of the latter, including any transmission arising from the downloading of any content by a User, any software applications used by the latter to download the content of the Web Site or of the server that can be used to access same. In this respect, the Users acknowledge that it is their responsibility to install anti-virus software and appropriate security applications on their computer equipment and on any other system in order to protect them against any bug, virus or other such malicious program.
4. User Content
4.1. Creation of User Content
The Users may create Product Pages (“Product Pages”) as well as Profile Page (“Profile Page”) and they can also post comments about the Products that are put online by other Users (the “Inquiries”). All of these elements created or posted by the Users shall be referred to as “User Content”. By uploading their Product Pages and/or of Profile Page, the Users authorise Re-nya and all its successors and assigns:
– To affix, store, reproduce, disseminate and exploit any User Content, worldwide, and for the entire duration of the protection afforded to these elements, in all formats, by any means and on all media, such as on the Web Site and on its commercial documents;
– To modify the presentation of the photographs of the Products, such as by resizing or cropping the photographs and removing the background of a Product so that it appears over a white background. Re-nya respects the intellectual property rights of others and accordingly prohibits the Users of the Web Site from disseminating, downloading, putting online or otherwise transmitting any element that infringes the intellectual property rights of a third party. The Users undertake to guarantee Re-nya and its senior officers, directors, servants, agents and suppliers against any claim, liability, damages, losses, costs and expenses, including the fees of lawyers and counsels up to a reasonable amount, that are incurred by Re-nya as part of or in connection with any claim brought by a third party over an infringement or violation of intellectual property rights by a User. More broadly speaking, the Users guarantee Re-nya against any claims raised by third parties in connection with the wording of their Product Pages and/or the description of the Products that they offer for sale on the Web Site.
4.2. No monitoring of the User Content by Re-nya
Re-nya has no control over and hereby disclaims liability for the accuracy or the correctness of any User Content or third party content; Re-nya shall not have any obligation to check the appropriateness of such content that is posted or downloaded on the Web Site. Re-nya shall act at all times merely as a host and hereby disclaims liability for the data or information that is uploaded by the Users, including any content that is put online or uploaded into a Product Page. Re-nya shall be entitled to remove any User Content in case of violation of the rights of a third party and/or of these Terms of Use governing the use of the Web Site. Only the Users who post or send information to the Web Site shall be liable for this information, which shall not necessarily reflect the opinions or the principles of Re-nya. Re-nya therefore does not guarantee that this information shall be complete and accurate. Any decision by a User based on the information posted or uploaded by other Users shall be taken based on their judgement alone and their sole assessment under their sole responsibility.
4.3. Notification of illicit content or infringement of intellectual property rights
If you think that any content and/or a Product Page contains a defamatory or illegal message or that your intellectual property rights have been infringed by an article or any information featuring on the Web Site, please notify this to Re-nya by consulting the Quick Contact form at the footer of the Web Site. It is the policy of Re-nya to respond as soon as possible to claims about infringements of intellectual property rights and to take action in response to any notifications of clear infringements of intellectual property rights. Should you have any claim or complaint regarding infringements of intellectual property rights, please send it to info@re-nya.com.
5. Rights over a person’s image
Upon creation of a Profile Page or a Product Page, Users may post photographs representing them. By accepting these General Terms and Conditions, the Users hereby authorise Re-nya to use their image as part of the operation of the Web Site. This authorisation is granted for the entire period during which a User shall have an account and/or a Profile Page on the Web Site.
6. Personal data
The Users must ensure that the data that they provide in the course of their registration is properly keyed in, truthful and accurate. Re-nya hereby declares that the personal data of the Users that it shall have obtained as part of their use of the Web Site, and in general, as part of its commercial relationship with the Users, shall be dealt with in accordance with the British laws that are applicable and in keeping with the principles of good faith, lawfulness, transparency and confidentiality. 7. Intellectual property statement concerning the Web Site
All of the content of the Web Site (texts, comments, illustrations and images, be they visual or audible) other than the User Content is protected by copyright, trademark and/or patent laws, for the world as a whole. Any total or partial reproduction of all or part of the Web Site is strictly prohibited and shall be considered as an infringement of the intellectual property rights of Re-nya and/or of its licensors.
8. Rules of good conduct
Each User undertakes to use the Website (and each of its existing and future functionalities) in a reasonable manner, in good faith, and in accordance with the laws and regulations in force and with the terms hereof. In particular, the User undertakes not to use the Website in such a way as to infringe, in any way whatsoever, intellectual property rights (copyright, trademark law, design and model law, etc.), personal rights (image, respect, privacy, etc.), fundamental rights and freedoms. The User is warned that its behaviour on the Website may be held liable towards other Users and Re-nya. Re-nya is not responsible for the behaviour of Users on the Website. In the context of the distribution of content through the Website, whether by choosing a pseudonym, by writing sales announcements and/or exchanges with other Users, or by publishing comments, each User undertakes to be polite, moderate and respectful. In particular, each User agrees not to post on the Website any content (and in particular any comment and/or message and/or any photo or video content, regardless of the main vehicle for diffusion) that is, without limitation, racist, anti-Semitic, negationist, pornographic, violent, vulgar, obscene, offensive, inappropriate, hateful, defamatory, discriminatory, harassing or otherwise objectionable. Re-nya reserves the right to delete the wrongful content, as soon as it becomes aware of it and/or as soon as it is notified of its existence. Re-nya can also ask the User to modify it at any time, for example by choosing an acceptable pseudonym. In general, when using the Website, any act, content, attitude and/or declaration of a User likely to deceive, mislead, shock, defraud, swindle or, in general, cause prejudice to any other User and/or to Re-nya (including members of its staff) may be subject to, at the discretion of Re-nya and without prejudice to any claim for compensation, (i) a reminder of the rules of good conduct, (ii) a formal notice, (iii) a temporary suspension or permanent interruption of access to the messaging tool between Users, (iv) a suspension or permanent interruption of a User’s account. Users formally refrain from contacting each other directly in order to negotiate and/or conclude a transaction relating to a Product outside the Website or, in general, in a manner that is detrimental to the rights or interests of Re-nya. Users also refrain from disseminating links to other websites and/or identification elements of other websites on which the Products would also be sold, except with the written agreement of Re-nya. Users agree not to disclose personal or bank details via the Website. Users undertake not to make any unfounded assessment of the Website and/or other Users that could be denigrating, or undermine the image of the services that have been provided and/or hurt the reputation of Re-nya (including members of its staff) and/or other Users. Any content deemed contrary to these rules shall be deemed to have been created by the User who issued it, whether through Re-nya or other Users.
9. Availability of the Web Site
Re-nya does not provide any undertaking concerning the availability or the accessibility of the Web Site and does not guarantee that the User’s access to the Web Site, the content featuring on the Web Site or the services that it offers shall be provided without interruption, within the timescales stipulated or free of errors. Re-nya endeavours to keep the Web Site accessible around the clock, 7 days a week, subject to force majeure. However, for reasons of technical maintenance and/or security, Re-nya may have to fully or partly suspend access to the Web Site, temporarily and without notice. The Users’ acceptance of these Terms of Use shall imply their acceptance of these possible technical interruptions. Re-nya shall be entitled to make changes to the Web Site, for instance for technical or commercial reasons. Where these changes do not significantly and/or negatively affect the terms under which the services are provided, the Users may be informed about the changes made, but their approval shall not be sought.
10. Applicable law and settlement of disputes
These Terms of Use are governed by British law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms of Use. Should the parties fail to reach an amicable settlement of their dispute, Re-nya and the User agree to submit it to the jurisdiction of the British courts. Nothing in these Terms of Use affects the User’s rights as a consumer domiciled in the United Kingdom to rely on the mandatory provisions of the local laws of their country of residence. The terms of this article shall not result in depriving consumers of the right to bring court proceedings or to defend themselves against court proceedings in the country where they reside or they are domiciled. Nor shall they deprive them of the protective measures stipulated in their favour by the applicable rules and regulations of their country of residence.
Seller Terms and Conditions – 24/2/2021
1. The role and responsibility of Re-nya
The Users hereby acknowledge that, save where otherwise specified for specific Products that are on offer on the Web Site, the role of Re-nya shall be limited to acting as an intermediation platform between the Users. Therefore, except in specific cases, Re-nya shall not act as a reseller of the Products and shall not become the owner of the Products at any point in time. The Users shall each act, at all times, for and on their own behalf, and never as agents or representatives of Re-nya. Re-nya shall not be a party to the contract of sale between the Buyer and the Seller, and hereby disclaims liability for such a contract or for its consequences. Any quality control that Re-nya may perform shall be merely designed to ensure that a Product sold by a Seller is in keeping with its description in the Product Page drawn up by that Seller. Moreover, any deliveries that are arranged by Re-nya and fulfilled by its subcontractors shall not imply that Re-nya is a party to the contract between the Seller and the Buyer. With the exception of any complaints for late delivery or for failures to deliver Products that may be blamed on Re-nya, it is up to the Seller to respond to any claim or complaint regarding the Products that they have advertised online or about their description, and to the comments of any User about the Product Page, and/or the dispatching and delivery of the Products by the Seller (whether or not this delivery shall have taken place as part of the sale, the exchange or the return of the Products), and any claim or complaint of this kind shall be referred to the Seller, which shall alone be responsible for dealing with same.
2. Electronic wallets
Re-nya reminds the Sellers that the Electronic Wallets are not available.
3. Sales of Products
3.1. Mandate
Within the scope of the online intermediation service performed by Re-nya, the Seller hereby grants Re-nya a mandate to do the following:
– to publish on the Web Site the Product Page that constitutes an offer to sell a Product, including all the content included by the Seller, and where applicable, to make changes to the photographs of the Product, to the extent of removing their background;
– to accept the order placed by the Buyer, for and on behalf of the Seller;
– to open a separate account on the books of Re-nya, for and on behalf of the Seller, and to credit the Price of the Product into that account; and
– to receive the moneys and to transfer them to the Seller, after subtracting the commission and any other sum of money due should any moneys remain outstanding between the parties, as stipulated by ARTICLE 10 of these T&Cs.
3.2. Creation and modification of the Product Page
3.2.1. Creation of the Product Page
A Product Page must be drawn up for each Product that a User wishes to offer for sale. The Seller must accurately describe all of the characteristics of the Product and must mention its Price in the Product Page. The minimum Price of each Product shall be twenty (20) British Pounds. The Products that are offered for sale must be available for ordering by Buyers as long as the Product Page appears on the Web Site. A Seller may permanently remove a Product that is advertised for sale from the Web Site at any point in time, provided that this Product has not been ordered, by deleting the Product Page. The Seller undertakes to comprehensively, honestly and accurately describe the Product’s characteristics, its brand, and any faulty workmanship, damage or wear, or other attribute of the Product that a Buyer would reasonably want to know at the time of buying that Product. The Seller undertakes not to publish an altered depiction of the Product. Should a Product have undergone any visible alterations prior to being put up for sale (customisation, personalisation, etc.), the Seller undertakes to mention this expressly in the Product Page. Re-nya shall be entitled to accept or to reject a Seller’s Product Page prior to its being put online on the Web Site in order to ensure the coherence of the Products that are offered for sale on the Web Site. The Seller should refer to the FAQ for details regarding the commission that it shall deduct from the Price.
3.2.2. Altering a Product Page
The Sellers may add comments in the space earmarked for this purpose. They may also add additional photographs of a Product that is listed on the Web Site, after publication of the Product Page on the Web Site. Any addition of images shall be subject to validation by Re-nya. These alterations of the Product Page shall not apply to transactions that are under way (namely after a buyer places an order for the Product). A Seller may lower the Price of a Product, in which case the Commission of Re-nya shall be adjusted in keeping with the Commissions Scale shown at the end of these T&Cs and the previous Price shall be shown crossed out on the Product Page. Re-nya may suggest that the Seller alter the Price of a Product in order to make it coherent with the prices of other Products listed on the Web Site and with the market’s expectations in general. The Sellers accordingly agree to discuss the Prices of their Products in good faith with Re-nya. Any alteration of a Price by Re-nya shall only become effective upon acceptance by the Seller. For the avoidance of doubt, the Price of a Product is determined by the Seller. Throughout the sale process, the Seller shall have full visibility over the Price and the corresponding Commission. Prior to advertising their Products for sale on the Web Site or lowering the Price of a Product, the Sellers must confirm, each time, that they accept the Price and Re-nya’s Commission.
4. Checking the compliance of the Products
If, at the time of the compliance check performed by Re-nya in those cases where the latter is in charge of arranging delivery of the Products bought by the Buyers, Re-nya notices that the Product does not comply with the Product Page drawn up by the Seller (such as in terms of the condition of the Product), Re-nya undertakes, at the Buyer’s discretion, (i) to negotiate with the Seller and the Buyer to secure a reduction of the Price, or (ii) to cancel the Transaction and refund the Buyer. Should the Transaction be cancelled, and should the Seller wish to get their Product back, Re-nya shall bill the Seller a fixed fee of £ 12 including tax per non-compliant and/or counterfeit item, corresponding to the minimum handling costs (the cost of sending the Product to Re-nya, the cost of removing the background from the photographs, the costs of sending the Product back to the Seller).
5. Consequences of an impossibility to deliver the Products (dispatched by the Seller)
If it is impossible to deliver a Product to the Buyer, for instance if the address provided by the latter is incorrect or the parcel is sent back due to non-acceptance by the Buyer, the Parcel shall be returned to the Seller in keeping with the terms of the carrier selected by the latter.
6. The Seller’s commitments and obligations
The Seller undertakes to sell only Products of which they are the sole owner, or in case of a sale on consignment of second-hand products, on behalf of a person who is the owner of the Products. The Seller hereby represents that they are not violating the prevailing laws and regulations in any way and are not infringing the rights of any third parties by submitting a Product Page to Re-nya or by offering a Product for sale via the Web Site. The Seller warrants, represents and undertakes (i) that the origin, the condition and the characteristics of the Product that they offer on the Web Site comply with that description of the Product on the corresponding Product Page, and (ii) that the Product that is offered for sale is not counterfeit. Should Re-nya request this, the Sellers must immediately provide it with all the documents proving their ownership of the Products that are offered for sale and/or the origin of these Products. Re-nya shall be entitled to delete the Profile and/or the Product Page of a Seller who fails to provide evidence to Re-nya of their ownership rights over the Product(s) that are offered for sale and/or of the origin of the Product(s). The Seller shall be barred from claiming any right to compensation if Re-nya deletes this information for the reasons mentioned above. The Seller shall be the only person responsible for the sale of a Product. The Seller shall refrain from selling any Product whose sale is prohibited or would violate the prevailing laws and regulations and/or infringe the rights of third parties. The Seller undertakes in particular not to sell prototypes (clothes or accessories that are created prior to production in series) or uniforms (clothes or accessories designed for use by the employees of certain brands) or Products that were included in “sales to employees” or “press sales” and whose resale is not authorised, bearing in mind that Re-nya shall be unable to check whether such a prohibition is applicable. Should Re-nya learn that any such Products are offered for sale on the Web Site, the Product Pages of the Products involved and/or the Profiles of their Sellers might be deleted as of right, and the latter shall not be able to claim any right to compensation. Once a Seller’s Product Page has been put online, the Seller must access their account regularly in order to take stock of all pending transactions and monitor them. Should the Seller be unable to connect and monitor their account during an extended period of time, they must inform prospective buyers about an extended fulfilment timescale.
7. Calculating the Commissions
The services on offer by Re-nya shall be remunerated by a Commission that Re-nya shall deduct from the Price of the Product paid by the Buyer. Re-nya shall calculate this Commission using the Commission Scale shown at the end of these T&Cs. The Commission taken by Re-nya shall correspond to the sum paid for each Transaction to Re-nya by the Buyers, in return for the intermediation services between Seller and Buyer, and where applicable for checking and dispatching the Products. This Commission shall be included in the sale Price of the Product as shown on the Web Site. This method of calculating the Commissions due shall apply to all the Products that are offered for sale on the Web Site. Please note that the adoption of a new Commission Scale shall not give rise to any refunds for Transactions that completed previously (for instance, if the Seller finds a difference between the Commission paid previously and the Commission based on the new Commissions Scale).
8. Sales of Products and payments due to the Seller
8.1. The process of checking the order
The Seller acknowledges being aware that the information concerning the Order placed by the Buyer shall be processed automatically by our partner in charge of fraud prevention, the aim of this automated processing of data being to prevent bank card fraud. Our partner in charge of fraud prevention and/or the “Risks” unit of Re-nya may also perform checks with the Buyer, by telephone,or by email, in order to confirm the Order prior to the Product being sent out; these checks may also include a request for additional elements of evidence. Pursuant to the checks that are performed, Re-nya may cancel an order if the information provided by the Buyer is deliberately erroneous and/or fraudulent, even after confirmation of the order. In that case, the Buyer shall be informed by email about the measures taken by Re-nya, which shall put the Product back on sale in the Seller’s account.
8.2. Sending and delivering the Products
8.2.1. Products that are dispatched to the Buyer directly by the Seller
Sellers may deliver Products directly to the Buyers, at the Buyer’s discretion. A Seller whose Product has been ordered by a Buyer shall receive a notification of this sale by an email informing them that the Product must be sent to the Buyer to check its compliance with its description in the corresponding Product Page. Sellers must secure evidence of dispatching each parcel that they send to Buyers. Sellers should endeavour to send the Products that they sell via the carrier that is allocated to them (after printing out the prepaid postage voucher) within seven (7) working days following the confirmation of the sale. No object should be enclosed other than the Products and the accessories sold with them, in particular no promotional or advertising documentation whatsoever. Re-nya disclaims any liability towards the Seller in case of damage caused to a Product or in case of loss of a Product during its transit to the Buyer if the parcel is dispatched without the prepaid voucher. In order to insure the Products optimally while in transit to the Buyers, the Sellers may take out, at their own initiative and at their own expense, an insurance policy covering loss or damage caused to a Product while in transit. In that case, the Sellers should not use the prepaid voucher sent by Re-nya. In any event, the Sellers shall be responsible for complying with the delivery timescales that shall have been brought to the attention of the Buyers during the ordering process.
8.2.3. Condition of the Products upon delivery
The Seller undertakes to only deliver Products that are perfectly clean (i.e. Products that have been cleaned and ironed if need be). In case of deliveries transiting via Re-nya, Re-nya shall be entitled to bill the Seller for reasonable costs incurred in cleaning and/or ironing the Products, and shall be entitled to deduct these costs from any moneys that are due to the Seller by Re-nya. In order to avoid any disputes, the Seller undertakes to take particular care in packaging the Products that they dispatch (for instance, by using opaque envelopes or wrapping reinforced with bubble-wrap and resilient fastenings). The Seller undertakes to retain evidence of sending any parcel that is dispatched, in a safe location, for a period of one month following the send date. In case of direct delivery, should a Buyer complain about the delivery of a Product that is in poor condition, after examining the Buyer’s claim, Re-nya shall inform the Seller, where applicable, that the Product shall be returned to it forthwith.
8.3. Payment of the Seller
The moneys received from the Buyer, after deduction of (i) the Commission due to Re-nya, (ii) any authentication costs, (iii) the Shipping costs, and (iv) any sum of money that remains due to Re-nya, such as any cleaning and ironing costs, shall be paid across in full to the Seller by Re-nya after the Compliance Department of Re-nya shall have confirmed that the Product complies with the Product Page or within three (3) days following the Buyer’s confirmation of receipt of the Product, if the latter did not transit via Re-nya. In case of a change of the Commissions Scale, any pending offers on the date on which the new Commissions Scale comes into force shall be null and void. However, after delivery of the Product to the Buyer, the Seller must reimburse the moneys received from Re-nya for the Transaction, immediately upon receiving a request to do so from Re-nya, and must reimburse any Shipping costs to the Buyer, if: (i) the Product turns out to be counterfeit or a Product whose sale is prohibited, in violation of the Seller’s obligations described in article 8.5 of these T&Cs; or (ii) the Buyer exercises their right to withdraw from the sale, during the statutory timescale of fourteen (14) calendar days, in case of a Product bought from a Seller. Should Re-nya not have paid any moneys to the Seller in connection with the Transaction, the Seller shall not be entitled to claim any payment for a Product that shall have been validly returned by the Buyer. The Seller hereby waives any claims over moneys (interest or other) generated by the temporary blockage of any sums taken by Re-nya as part of the Transaction. Should a Seller want the moneys that they are owed to be paid by bank transfer, a bank transfer shall be made into the bank account designated by the Seller. Re-nya shall only make bank transfers after the Compliance Department of Re-nya shall have confirmed that the Product complies with the Product Page or within three (3) days following the Buyer’s confirmation of receipt of the Product, if the latter did not transit via Re-nya. Should the Seller opt for payment by a bank transfer into their bank account, bank costs may be charged, for instance in the case of accounts domiciled in countries other than the United Kingdom. The Seller should check the terms applicable to such transactions with the banking establishment that holds the bank account involved. In case of a claim or complaint by the Buyer, Re-nya shall be entitled to withhold payment to the Seller until the claim or complaint shall have been resolved. Sellers should note that the moneys that are due to them shall not be credited immediately into their bank account, due to processing and handling delays of around five (5) working days (in the case of banks) after the Product is found to be compliant, these delays being subject to fluctuation and being provided for information purposes only. Should a Seller not pay any moneys that are due to Re-nya, Re-nya, after bringing this to the attention of the Seller in writing, shall be entitled (i) to offset any moneys that remain due against the moneys that it is supposed to pay across to that Seller, and/or (ii) to impound any Products that are bought or sold by the Seller, until full payment of the moneys that are due to Re-nya, and/or (iii) to offset as a priority the moneys that it receives as part of a new Transaction against the moneys that remain due, provided that the Seller settles any outstanding balance in order to be able to acquire the new Product that they are planning on buying. In order to receive payments, the Sellers must input their bank account details into their client account, in order for Re-nya to be able to make a transfer to their bank account. Please note that the family name and the first name of the Seller must correspond to those of the bank account in order for the transfer to be authorised by the bank involved.
8.4. Sales of Products imported into the United Kingdom
Re-nya reserves the right to request that Sellers who are based outside the territory of the United Kingdom or who offer for sale Products located outside of this territory provide all the documents certifying that they have obtained permission from the holder of the rights. Should a Seller not provide these documents to Re-nya, Re-nya shall be entitled to cancel any Transaction and to suspend the Seller’s account. Re-nya shall be entitled to bill the Seller for any customs duty that is levied when the Product is dispatched by the Seller to Re-nya.
8.5. Advertising of counterfeit Products or Products whose sale is prohibited on the Web
Site
Re-nya is committed to applying the procedures for taking action against the sale of counterfeit goods, in favour of both consumers and the rights holders. The Sellers warrant and represent that the Products that they put up for sale are not counterfeit and that their sale is not prohibited. However, if in spite of the care taken to physically inspect the Product, a Buyer receives a counterfeit item or a Product whose sale is prohibited, they may return it to Re-nya in order to secure a refund. Should a counterfeit Product or a Product whose sale is prohibited be discovered, it shall immediately be withdrawn from circulation and the Seller’s account may be suspended temporarily or permanently. Moreover, should a counterfeit Product or a Product whose sale is prohibited be put up for sale on the Web Site, the Seller of this Product shall bear the risk that this Product might be seized by the appropriate authorities or by the owner of the brand involved, which might impound it or destroy it. The Seller shall then have to personally retrieve the Product in question at their sole risk and expense. Please note that counterfeiting is subject to specific sanctions. Should a counterfeit Product or a Product whose sale is prohibited be nevertheless put up for sale or seized by the appropriate authorities or by the brand that owns the intellectual property rights concerned or by the holder of the rights, after it has been sold, the Transaction shall be cancelled. The Seller must then refund to Re-nya the moneys that it shall have taken in connection with the sale of the contentious Product and shall have to compensate Re-nya for any costs incurred by the latter and/or by the Buyer owing to the Seller’s activity; the Buyer shall also be liable for any costs, losses, expenses and damages incurred by Re-nya in relation to any legal action arising in relation to the contentious Product. In case of doubt over the authenticity of a Product, Re-nya reserves the right to request from the Seller any and all documents certifying the authenticity of the Product and to suspend the Seller’s account until it shall have received these documents. Re-nya shall also be entitled to get in touch with a Seller in order to verify the authenticity of a Product.
9. Transfer of the ownership of the Products and the risks
The Products shall remain the property of the Seller until Re-nya shall have received full payment of the Price of the Order from the Buyer, including both capital and ancillary elements (taxes, Authentication Costs, Shipping Costs and any other costs that may be applicable). The transfer of the risks of loss or damage of a Product to the Buyer shall take place upon receipt of the Product by the Buyer or by a third party that the Buyer shall have commissioned to act on their behalf. The Buyer shall therefore bear the risk linked to any damage caused to the Product after it is received.
10. Claims and returns
10.1. Non-receipt or late delivery of a Product
Should the Buyer not receive the Products within thirty (30) days following the date of the Order, the Buyer may cancel the Transaction by sending an email to Re-nya, provided that it shall first have summoned Re-nya, by the same means, to rectify the situation within a reasonable timescale and provided that delivery shall not have taken place within this additional timescale. Re-nya shall refund the Buyer within fourteen (14) calendar days following the date on which Re-nya receives the email sent with acknowledgement of receipt informing it about the cancellation of the Transaction. Should the Buyer receive the Products whereas they have already cancelled the Transaction, they must return the Products and Re-nya undertakes to refund the Price of the Products that are returned, the Authentication Costs, the Shipping Costs (in case of return of the Order as a whole) and the cost of returning the Product to the Seller, within fourteen (14) calendar days following Sellers’s receipt of the complete Products in their original condition. These returns must take place in accordance with the terms of article 10.3.3 below. In case of cancellation, the Buyer shall be refunded in cash (the moneys being credited to the bank card that the Buyer used to make the payment) provided that, in each case, Re-nya does not suspect that the request for cancellation or for a refund due to total or partial non-receipt of a Product that was ordered was made fraudulently. In the case of a partial cancellation, only the part of the Order that is cancelled shall be refunded in keeping with the foregoing terms.
10.2. Products that do not comply with their Product Page
Please note that Re-nya’s involvement in resolving claims or complaints pursuant to a purchase from a Seller is designed to facilitate the procedure and shall not result in Re-nya being considered a party to the sale.
10.2.1. Findings during the quality control that is performed by Re-nya
Should Re-nya find that the Products correspond partly to their description, then at the Buyer’s discretion, (i) it shall either negotiate a lower Price with the Seller, or (ii) it shall cancel the sale and shall refund the Buyer. Should the Buyer and the Seller agree over a Price cut, the latter may take the form of a credit note from Re-nya, a Purchase Voucher or a payment re-credited to the method of payment used by the Buyer. In the case of Products that do not correspond to their description in the Product Page provided by the Seller, products that are counterfeit or whose sale is prohibited, Re-nya shall cancel the Transaction and shall refund the Buyer. Should the Transaction be cancelled, the Buyer may obtain a cash refund which shall be credited to the method of payment that the Buyer used initially. In the case of a partial cancellation, only the part of the Order that is cancelled shall be refunded in keeping with the foregoing terms.
10.2.2. Detection of non-compliance upon receipt of the Product by the Buyer – Case of a Product bought from a Seller:
Should the Buyer find that a Product does not comply with its description in the Product Page, the Buyer shall have the right to raise a claim with the Seller through Re-nya in accordance with the applicable statutory warranties. Upon making a complaint about a Product that does not comply with its description in its Product Page, the Buyer must return the Product or make it available for collection. Sellers hereby acknowledge and agree that should a Product be returned to them by a Buyer owing to non-compliance with its description in the corresponding Product Page or because it does not meet the legal obligations of the Seller, the Seller may not refuse to apply the foregoing terms and must take appropriate action within a reasonable timescale. Should the Buyer believe that they have received a counterfeit item or a Product whose sale is prohibited, they must alert Re-nya by email within seventy two (72) hours following receipt of the Product and may return the Product to Re-nya in order to secure a refund, save in case of fraud on their part. The provisions of this article shall not cause Re-nya to be a party to the sale between the Seller and the Buyer. Re-nya hereby disclaims liability for any failure by a Seller to comply with their obligations under this article 10 and in particular in the event of the Seller’s failure to comply with their obligation to refund the Buyer or pay the latter any other compensation in connection with a Product that is returned by the Buyer because it does not comply with its description on the corresponding Product Page, because it is counterfeit or because its sale is prohibited.
10.3. Specific provisions applicable to Sellers
10.3.1. The status of Seller
Any Seller must declare itself as such on the Web Site. Re-nya hereby reminds Sellers misleading commercial practices are strictly prohibited. Upon registration on the Web Site or even subsequently if their status changes after registration, Sellers must therefore disclose to Re-nya that they are acting in a professional capacity. Re-nya shall then inform the Users about this. Sellers shall not be subject to the standard Commission and shall benefit from specific commission rules as part of their contract of sale on consignment or online brokerage.
10.3.2. General obligations of Sellers
Sellers undertake to perform their legal obligations linked to the sale of Products to Buyers, and undertake in particular:
– not to commit any act or omission that might mislead Buyers in order to make them buy a Product that they would not have bought otherwise;
– to honour the right of Buyers to withdraw as laid down by the applicable rules and regulations as well as all other rights that the Buyers may have under the applicable rules and regulations, and under the applicable statutory warranties in particular; and
– to ensure that any Product that they offer for sale on the Web Site complies with its description in the Product Page, is of satisfactory quality and is suited to the use indicated by the Seller in the description or to any use for which this kind of Product is usually designed, and save where it is otherwise provided, is free of any fault affecting its materials, design or production, and to therefore guarantee the Buyer under the statutory compliance warranty and the statutory warranty against hidden defects. Moreover, Sellers shall be responsible for making all requisite declarations before the relevant authorities to comply with the applicable regulatory provisions (such as their registration obligations). Re-nya hereby draws the attention of the Sellers to the fact that Sellers that sell items regularly and/or that sell a large number of items may be qualified as sellers by the tax or other authorities and may therefore be subject to the obligations that are applicable to Sellers by virtue of the applicable regulations and these T&Cs. It shall be the responsibility of the Users to comply with all their obligations, including making the requisite declarations to the relevant authorities so as to comply with the applicable regulatory provisions, and Re-nya hereby disclaims liability in this respect. Re-nya reserves the right to request that Sellers provide it with any documentation confirming their identity and their address in order to be able to check and keep information concerning the identity of the Sellers and their contact details as well as their identity documents throughout the existence of their account and for a period of five (5) years following the closure of their account.
10.3.3. Returns
Sellers acknowledges that if a Product is returned by a Buyer owing to its non-compliance with the description on the Product Page or because it infringes these T&Cs and/or the legal obligations of the Seller involved, the Sellers may not refuse to refund the Product (and the Shipping fees linked to the Order) to the Buyer, or to repair the Product (if this is reasonably possible), at the Buyer’s discretion, and in each case within a reasonable timescale. Should a Transaction be cancelled pursuant to the Buyer exercising their right to withdraw from the sale or in case of a compliance defect found in a Product, counterfeit Products or Products whose sale is prohibited, and the Seller wants the Product involved to be returned, it must inform Re-nya using the inquiries section. The Seller must then pay Re-nya a fixed fee of £ 12 including tax per counterfeit and/or non-compliant item, corresponding to the minimum handling costs (costs linked to the sending of the Product to Re-nya and costs linked to the re-sending of the Product to the Seller) and must refund to Re-nya the moneys that it shall have received as part of the sale as well as the Shipping costs due in connection with the Order, where applicable. In this case, the Seller has a period of one (1) year to claim the item and to pay the fee of £ 12 (or equivalent in another currency, at the appropriate conversion rate) for the return of the item. Failure to pay the fee within this period will automatically result in Re-nya being granted permission to destroy the item by whatever means are deemed necessary.
10.3.4. Information about the approval and processing of offers
Terms of approval
Any person who has come of age and who holds a valid account with Re-nya can advertise a Product for sale on the Re-nya platform. The account holder may either act as a trade or private operator.
Terms governing the removal of offers
An offer for sale might not be published or might be withdrawn by Re-nya for the following reasons:
– the Product on offer is a prohibited product as per the meaning of this term in the Terms of Use of Re-nya for it runs counter to public morals or its sale is prohibited under statutory, regulatory or contractual provisions. This concerns among other things Products that constitute counterfeit goods or that are sold in violation of selective or exclusive distribution networks;
– there is an error on the Product Page of the offer;
– the Re-nya account of the Seller of the Product is suspended or cancelled, whatever the reason for this;
– the Product that is advertised has already been sold.
11. Duration and validity
The Users shall be governed by these T&Cs from the moment that they accept them upon accessing the Web Site or upon registering on the Web Site, and until the cancellation of their account, whether or not they perform any Transactions. Re-nya shall be entitled to modify its General Terms and Conditions at any point in time, without notice and without any obligation to justify its decision, without incurring any liability as a result. In case of a significant change of one of the clauses of these T&Cs, the Users who accepted their terms and conditions beforehand shall have to accept the new version of these T&Cs. The General Terms and Conditions that are applicable shall be those that are in force on the date on which the User uses the Web Site and/or purchases a Product, depending on the nature of the changes made to the General Terms and Conditions.
12. Interruption of the service and rescission
In case of a failure to comply with one or more of the clauses of these T&Cs (such as in case of a failure to pay any moneys due within the allotted timescales, or a violation of these T&Cs), whether this is witnessed by Re-nya or gives rise to a justified complaint by other Users, Re-nya may temporarily interrupt the User’s access to the services of Re-nya, for instance pending a rectification of the contentious situation. If the violation can be rectified but such a rectification does not take place within two (2) calendar days following the notification of the irregularities witnessed by Re-nya, Re-nya shall have the right to permanently bar the User from accessing the services. This irrevocable withdrawal of the User’s access shall be preceded by the sending of an email to the User involved, informing them about this impending measure and the reasons for taking it, without any other formalities and notwithstanding any compensation that Re-nya may claim for any loss or damage that it shall have incurred. Moreover, Re-nya may put an end to the services provided, as of right, without prior notification, effective immediately, if the behaviour of the User constitutes a serious violation of these T&Cs, such as, but not limited to: opening several accounts, fraudulent use of methods of payment, attempted fraud, or any other criminal offence. Such a measure shall not give rise to any right to compensation whatsoever from Re-nya, and the latter shall itself be entitled to claim compensation for any loss or damage that it may have incurred. Should Re-nya cancel any Transaction(s), the Users shall be refunded automatically in cash (the sum being credited to the card used for the payment)
13. Complaints
Any User wishing to make a complaint against Re-nya concerning the Web Site may send an email to Re-nya at info@re-nya.com
14. Mediation
Should a dispute arise between a User and Re-nya, Re-nya recommends that the User get in contact with Re-nya in order to try to resolve the dispute amicably. Re-nya shall inform the User in this respect about the existence of alternative modes of settlement of disputes, such as mediation or arbitration.
15. Commissions
Flat rate of 20% commission will be applied to all sales.
Buyer Terms and Conditions
1. The role and responsibility of Re-nya
The Users hereby acknowledge that, save where otherwise specified for any given Products that are on offer on the Web Site, the role of Re-nya shall be limited to acting as an intermediation platform between the Users. To that end, save in case of specific circumstances, Re-nya shall not act as a reseller of the Products and shall not become the owner of the Products at any point in time. Each User shall act, at all times, for and on its own behalf and shall never act as an agent or representative of Re-nya. Re-nya shall not be a party to the contract of sale between the Buyer and the Seller, and hereby disclaims liability for such a contract or for its consequences. Any quality control potentially performed by Re-nya shall merely relate to whether the Seller’s Product is in keeping with its description in the Product Page drawn up by the Seller. Re-nya shall not check whether the Product or the description of the Product in the Seller’s Product Page meet the Buyer’s expectations. Therefore, Re-nya does not guarantee that the Buyer shall find the Product satisfactory, whether from an aesthetic point of view or from a practical point of view, as to its use. Any deliveries that are arranged by Re-nya and fulfilled by its subcontractors shall not imply that Re-nya is a party to the contract between the Seller and the Buyer. With the exception of any complaints for late delivery or for failures to deliver Products that may be blamed on Re-nya, it is up to the Seller to respond to any claim or complaint regarding the Products that they have advertised online, their description and the comments of any User about the Product Page, and/or the dispatching and delivery of the Products by the Seller (whether or not this delivery shall have taken place as part of the sale, the exchange or the return of the Products), and any claim or complaint of this kind shall be referred to the Seller, which shall alone be responsible for dealing with same.
2. The Buyer’s placing of the Order
The Product Page shall state whether the Product that is offered for sale belongs to and is sold by a Seller, which may in some cases be Re-nya itself. The information concerning the Products is provided by the Sellers in their original language. The original language of the Product Page shall prevail in case of any contradiction or conflict with a translation. Re-nya disclaims any liability for the translation that is proposed, which shall be provided for information purposes only. The Prices of the Products that are offered for sale on the Web Site are quoted excluding tax and any additional costs (Shipping Costs and customs duty) that shall be indicated separately. Certain Shipping taxes and customs duties that are in force in some countries may nevertheless be billed over and above these additional costs, as shall be mentioned during the payment of the Order. In any event, all of the costs shall be set out in the summary of the Order, before the Buyer approves it. The Buyer’s confirmation of an Order shall be tantamount to signature of the contract subject to conditions precedent, namely the receipt of the Product by Re-nya and the positive outcome of the compliance check, if such a check is performed by Re-nya. Should it not receive the Product or should the outcome of its quality control checks be negative, Re-nya shall be entitled to cancel the Order and to refund the Buyer. As an exception to the above, where Re-nya is itself acting as the Seller of the Products or where the Products are delivered directly by the Sellers to the Buyers, the sale shall be deemed to have been signed upon the Order being placed. Should a Product ordered by the Buyer be unavailable for any reason whatsoever, after confirmation of the Order, Re-nya shall get in touch with the Buyer in good time to propose the cancellation of the Order and a refund (if payment has already been made), within thirty (30) calendar days following the confirmation of the Order. Re-nya shall be entitled to reject any Order from a Buyer with whom there is an outstanding dispute concerning payment for a previous Order or concerning a Product for which there is a blatant error in the sale Price. In that case, the Buyer shall be informed by email about the measures taken by Re-nya, which shall then automatically refund the price of the Order if the latter was already paid by the Buyer.
3. Delivery
The Products may be sent directly by the Seller. Where Re-nya itself sells any Products on the Web Site, a delivery date shall be indicated to the Buyers when they place their Orders. Where Re-nya is merely acting as an intermediary on behalf of the Seller, the delivery date of the Product to the Buyer shall depend on the date on which Seller posts the Product. Re-nya cannot therefore commit to a fixed delivery date, but the date on which the Product is dispatched shall be at most thirty (30) calendar days after the date of the confirmation of the Order by the Buyer. If a Product is dispatched directly by the Seller, the delivery timescale shall be stated by the Seller. The Order shall be delivered to the Buyer by a carrier approved by Seller. The Shipping Costs shall be calculated based on the value of the Products ordered and shall vary depending on the country to which the Orders are to be delivered. The Shipping Costs may be modified in keeping with the rates charged by the carrier and shall be stated upon placing the Order. The Shipping Costs that are applicable to the Order shall be those that are specified just prior to the approval of the Order. Any customs duty shall be borne by the Buyer. Upon finalisation of the Order, any customs duty, whose amount shall vary depending on the country of delivery, shall be added to the Price of the Product and the Buyer shall not have to pay anything upon receipt of the Product.
4. Consequences of an impossibility to deliver the Products
If it is impossible to deliver a Product to the Buyer, for instance if the address provided by the latter is incorrect or the parcel is sent back due to non-acceptance by the Buyer, the Parcel shall be returned to the Seller in keeping with the terms of the carrier selected by the latter.

6. Receipt and checking of an Order
The Buyer must check (or commission the person who receives the Product on their behalf to check) the apparent state of the packaging of the Product upon receipt, before signing the form tendered by the carrier. Should there be a visible anomaly (damage, missing Product, damaged parcel or Product, etc.), the Buyer or their representative must imperatively set out precise reservations on the delivery note: indication of the number of missing and/or damaged parcels and/or Products, and detailed description of the damage (open or torn packaging, damaged or missing Product, etc.). It is vital that the Buyer should keep all the elements that were delivered in the state in which they were delivered to it (i.e. with all their accessories, the others items received with these Products in their original condition and the sealed Product form). The Buyer must retain a copy of the delivery note and must enclose this with the email sent to Re-nya within seventy two (72) hours following the date of the receipt of the Products, confirming the anomaly. Where applicable, the return of the damaged Product or Products to Re-nya must take place in accordance with the terms governing returns that are set out in Article 10 below. Should the Product have been dispatched directly by the Seller, the damaged Products must be returned to the latter (save in case of counterfeit goods).
7. Terms of payment
The Buyer must pay the Price, the Shipping Costs and any other applicable costs via the secure payment system of Re-nya, by bank card, VISA card, Mastercard, American Express card, Discover card, JCB cards, or via Diners club. Re-nya enables Buyers to register their VISA and Mastercard card details for payments in GBP. The payment details shall not be kept by Re-nya but by Stripe, its payment services provider. The Buyer may subsequently remove any cards that they shall have stored at any point in time and may select a security option enabling the automatic erasure of their bank account details in case of resetting of their password, by visiting the “My Account” page. Re-nya shall notify the Buyer and the Seller by electronic mail, upon receipt and cashing of the moneys paid by the Buyer.
8. Claims and returns
8.1. Non-receipt or late delivery of a Product
Should the Buyer not receive the Product within thirty (30) days following the date of the Order, or should the Buyer not receive the Products on the delivery date mentioned upon placing the Order, the Buyer may cancel the Transaction by means of a message to the Seller, by the same means, to rectify the situation within a reasonable timescale and provided that delivery shall not have taken place within this additional timescale. Seller shall refund the Buyer within fourteen (14) calendar days following the date on which the message was received. Should the Buyer receive the Product whereas they have already cancelled the Transaction, they must return the Product to the Seller. Re-nya undertakes to refund the Price of the Product that is returned and the Shipping Costs (in case of return of the Order as a whole) within fourteen (14) calendar days following receipt by the Seller of the complete Product in its original condition. These returns must take place in accordance with the terms of Article 10 below. In case of cancellation, the Buyer shall be refunded in cash on the method of payment that they used to pay for their Order, provided that, in each case, Re-nya shall not suspect that the request for cancellation or for a refund due to total or partial non-receipt of a Product that was ordered was made fraudulently. In the case of a partial cancellation, only the part of the Order that is cancelled shall be refunded in keeping with the above mentioned terms.
8.2. Detection of non-compliance during the quality control that may be performed by Re-nya
The consequences of a Product’s non-compliance with the Product Page, as witnessed by Re-nya, shall depend on the type of non-compliance involved. If the Product that does not comply with its description in the corresponding Product Page is counterfeit or it is a Product whose sale is prohibited, Re-nya shall cancel the sale and shall refund the Buyer. Should the Product comply partly with its description, Re-nya may, at the Buyer’s discretion, either (i) negotiate with the Seller to secure a cut in the Price, or (ii) cancel the sale and refund the Buyer. Should the Buyer and the Seller agree over a Price cut, the Seller may credit the Buyers account. Should the Buyer cancel their Order, they shall be refunded in cash by crediting the bank card used to make the initial payment. In the case of a partial cancellation, only the part of the Order that is cancelled shall be refunded in keeping with the above mentioned terms.
8.3. Detection of non-compliance upon receipt of the Product by the Buyer
Should the Buyer find that a Product does not comply with its description in the Product Page, the Buyer must contact Re-nya by email within seventy two (72) hours following the date on which they received the Product. The Buyer must explain to what extent the Product does not correspond to the Product Page and must provide photographs enabling their assertions to be substantiated.Should the claim of non-compliance of the Product with the Product Page appear justified at first sight based on the explanations of the Buyer and the photographs, Re-nya shall authorise the Buyer to send the Product back to the Seller. Re-nya shall refund the Buyer upon confirmation of receipt of the Product by the Seller. The eventual refund shall take place by crediting the bank car.
9. Right to withdraw in case of a purchase from a Seller
Where a Buyer buys a Product from Seller, they shall have a timescale of two (2) calendar days following purchasing of the Product to exercise their right to withdraw by contacting the Seller only if the product has not been shipped. During this period, the Buyer may exercise their right to cancel the Transaction by contacting the Seller, without having to provide a valid reason nor pay any penalties. The Buyer may also inform Re-nya, clearly and unambiguously, about their intention to exercise their right to withdraw, by any other means within the above mentioned timescale. Re-nya shall thereupon refund to the Buyer (using the same means of payment that the Buyer used to pay for their Order) all the moneys that they shall have paid, i.e. the Price and the standard Shipping Costs within five to ten (5-10) business days following the refund request. Where a Buyer buys a Product from a Seller, the Buyer does not have any right to withdraw from the sale after the above mentioned timescale.
10. Terms applicable to returns
10.1. For all returns
Any User wishing to return a Product must contact the seller and provide a valid reason for the return listed in the FAQ.
10.2. Returns to the Seller
The Products should be returned to the address indicated by the Seller. Re-nya disclaims any liability in case of loss or damage of a Product while in transit.
11. Duration and validity
The Users shall be governed by these T&Cs from the moment that they accept them upon accessing the Web Site or upon registering on the Web Site, and until the cancellation of their account, whether or not they perform any Transactions. Re-nya shall be entitled to modify its General Terms and Conditions at any point in time, without notice and without any obligation to justify its decision, without incurring any liability as a result. In case of a significant change of one of the clauses of these T&Cs, the Users who accepted their terms and conditions beforehand shall have to accept the new version of these T&Cs. The General Terms and Conditions that are applicable shall be those that are in force on the date on which the User uses the Web Site and/or purchases a Product, depending on the nature of the changes made to the General Terms and Conditions.
12. Interruption of the service and rescission
In case of a failure to comply with one or more of the clauses of these T&Cs (such as in case of a failure to pay any moneys due within the allotted timescales, or a violation of these T&Cs), whether this is witnessed by Re-nya or gives rise to a justified complaint by other Users, Re-nya may temporarily interrupt the User’s access to the services of Re-nya, for instance pending a rectification of the contentious situation. If the violation can be rectified but such a rectification does not take place within two (2) calendar days following the notification of the irregularities witnessed by Re-nya, Re-nya shall have the right to permanently bar the User from accessing the services. This irrevocable withdrawal of the User’s access shall be preceded by the sending of an email to the User involved, informing them about this impending measure and the reasons for taking it, without any other formalities and notwithstanding any compensation that Re-nya may claim for any loss or damage that it shall have incurred. Moreover, Re-nya may put an end to the services provided, as of right, without prior notification, effective immediately, if the behaviour of the User constitutes a serious violation of these T&Cs, such as, but not limited to: opening several accounts, fraudulent use of methods of payment, attempted fraud, or any other criminal offence. Such a measure shall not give rise to any right to compensation whatsoever from Re-nya, and the latter shall itself be entitled to claim compensation for any loss or damage that it may have incurred. Should Re-nya cancel any Transaction(s), the Users shall be refunded automatically in cash (the sum being credited to the card used for the payment).
13. Complaints
Any User wishing to make a complaint against Re-nya concerning the Web Site may send an email to Re-nya at info@re-nya.com, submit a support ticket, or via My Account.
14. Mediation
Should a dispute arise Re-nya recommends that the User get in contact with Re-nya in order to try to resolve the dispute amicably. Re-nya shall inform the User in this respect about the existence of alternative modes of settlement of disputes, such as mediation or arbitration.
15. Applicable law and settlement of disputes
These T&Cs are governed by British law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these T&Cs. Should the parties fail to reach an amicable settlement of their dispute, Re-nya and the User agree to submit it to the jurisdiction of the British courts. Nothing in these T&Cs affects the User’s rights as a consumer in their country of residence. The terms of this Article shall not result in depriving consumers of the right to bring court proceedings or to defend themselves against court proceedings in the country where they reside or they are domiciled. Nor shall they deprive them of the protective measures stipulated in their favour by the applicable rules and regulations of their country of residence.
